Notary Application Information

To become a Notary or to renew your appointment you must:

  1. Be at least 18 years of age
  2. Live or work in Virginia and
  3. Read and write English

In an effort to assist Notary Applicants, the Clerk's Office offers an alternative to the instructions provided on the Commonwealth of Virginia Notary form. They are as follows:

  1. Complete Parts 1, 2, and 3 of the Application for Appointment of Notary Public. Effective July 1, 2007, Virginia Judges and Circuit Clerks and Deputy Clerks are no longer eligible to sign these forms. Effective July 1, 2007, Part 4 of your application must be signed by a Clerk or Deputy Clerk of a General District Court, Commonwealth's Attoreny Assistant Commonwealth's Attorney, the Attorney General or an Assistant Attorney General or a member of the General Assembly.
    • If you will bring your check or money order in the amount of $35 made payable to the "Treasurer of Virginia" and a stamped, self-addressed envelope, we will be glad to drop in the mail for you.
  2. In approximately four (4) weeks, a letter will be sent to you from the Secretary of the Commonwealth stating that your commission has been processed.
  3. Upon receipt of this letter, please call (757) 564-2242 before you return to the Clerk's Office to confirm that we have received the commission.
  4. The notary must be commissioned in his or her legal name that is identical to the name that appears of the forms of the forms of identification that he or she produces for the oath to be administered and the commission has been issued. I.E. If you bring your driver's license as proof of your identity, then your notary commission must be exactly the same.
    • After receiving this confirmation, come to the Circuit Court Clerk's Office on the First Floor of the Courthouse to take your oath and receive your commission. A $10 fee will be due at that time. You may pay in cash or by check payable to the "Clerk of Court."

Notary Applications are available at www.commonwealth.virginia.gov or may be picked up at your local circuit court clerk's office. A commission as notary is good for four years. The process for renewing a commission is the same as applying for an original commission.
