James City County Warrants

 

A warrant is a legal document issued by a judge, a clerk of any court, or a magistrate based upon Probable Cause.

 

An arrest warrant directs law enforcement (LE) to take a person into custody and to bring that person before the court to answer some criminal charge.

 

A search warrant directs LE to search a specific person, place, or thing in order to seize and take into custody, if found, certain persons or items (evidence or fruits of crime).

 

An arrest warrant is issued based on written sworn statements (Probable Cause) by LE or a private citizen.  For an arrest warrant, this document is called a criminal complaint. 

 

A search warrant is issued based on sworn statements (Probable Cause) by LE.  For a search warrant, this document is called a search warrant affidavit.

 

A Juvenile Petition is basically same as an arrest warrant but is used for juveniles.
